High court declines to lift ban on KPL

The Kenya premier league suffered a blow on Wednesday when high court judge Msagha Mbogholi refused a petition by KPL clubs to lift. KPL Ltd yesterday moved to court seeking to have the orders barring it from running or managing the Kenya Premier League lifted without success. Football Kenya Federation (FKF) had moved to court through Chairman Sam Nyamweya and obtained orders restraining the company from hosting or managing a parallel premier league.

KPL lawyer Ben Akech submitted that the order by the court to suspend the company from running the competition for 14 days would adversely affect players, coaches and thousands of football fans.

“Unless the orders granted herein are set aside, more than 500 football players, coaches and thousands of football fans following the premier league irreparable harm and damage would be occasioned on them,” submitted Akech.

KPL argued that the orders granted by the court were graned on the basis of material non-disclosure and misrepresentation. The football company added that FKF did not disclose to court the existence of regulation 68 of the FIFA statute which prohibits recourse to courts in dispute involving its members.
However the the High Court on Wednesday directed that two separate applications filed by Football Kenya Federation and the Kenyan Premier League over a dispute on the running of the country’s top tier club competition be jointly heard on Tuesday.

    Unfortunately the money from FKF was used to entice the NSL teams otherwise if all the teams had stayed put they would have forced KPL and FKF to reach an agreement on the matter

    Why are these NSL teams celebrating? Are they really serious that they want to do away with the big teams of this country? You look left you see greed ,right you see greed, north or south you see just the same thing and that is Kenya for you.There is a serious dispute now and they jumped onto the opportunity to eat,why could they be in solidarity with their bigger brothers to find a lasting solution to these problems? BETRAYAL all round whichever way one looks at it.

    Sam Nyamweya is simply uncontrollable…….what is next ? remember what Nywamweya said about Gor Mahia and AFC ?…the club is not owned by one person !!! hmmmm , I smell a rat …….No more Kogallo, no more Efusi, so what is his plan with the FIFA billions to transform FKF ?

    1. split Gor Mahia fans by forming two parallel clubs – Reunion and Kisumu united and have them registered in FKF.

    2. split Efusi fans by forming two parallel clubs – Kakamega Homeboyz and Busia United and have them registered in FKF.

    By simply using his FIFA muscle, the guy will have killed the two clubs once and for all. Are we witnessing the beginning of the destruction ? 1980’s divide and rule is back !!!!!!

    I urge EC once more, for the sake of the future of this club, let us consider FKF option….IF YOU CANT BEAT THEM, JOIN THEM !!!

      @Jakoyo, Principles are very important in everything one does. Once we consider KPL then it means that we don’t care what happens to our comrades-in-arms i.e. Tusker, Sofa, Ulinzi, Bandari etc. The big clubs always have issues with the FAs and fight it out. FIFA itself has a problem with UEFA and the big clubs in Europe which were even thinking of creating a European Super League. The moment we look desperate we will join that FKF league which is actually a lower tier league by its composition

    Let’s wait & see what the Judges says on Tuesday but surely the good judge should have maintained the status quo until Tuesday when he was ready to hear both parties so as to avert mischief on the part of FKF.

    But I think FKF outsmarted KPL by running to court first.
    The government is also right not to get directly involved in this saga hence keeping FIFA at bay.

    Who is this MP & Silva?
    Why don’t they come out in the open?

    My friends all this will pan out once the clouds clear in a month or two.
    The premier league involves travelling expenses, the so called 50% statutory deductions not to mention EVERYBODY WILL WANT THEIR PROPORTION OF THE 1M- CHAIRMEN, PLAYERS, COACHES ETC.

    I also challenge the club chairmen of the big two.
    Why pay an arm and a leg to bring in a foreign coach yet players (& local TB staff) have salary arrears of upto even 3 months.
    We all know Logarusic, and may AFC parted with a couple of millions to get him to set foot in Kenya yet the players have not been paid for months.
    Hope its not the same with our beloved K’galo. EC please declare that the 2015 wage bill is guaranteed.
    What became of the branch chairmen’s meeting. Were all challenges addressed?

    No….I have not been hired by FKF nor KPL and never will . Mass action is not the issues, the issue at hand here is the welfare of players and their future careers. forget coaches, referees and anybody else, they can easily relocate elsewhere.

    @dan original, bandari players have jobs at KPA, ulinzi players are in full time military employees e.t.c e.t.c what about Kogallo players ?

    I Think its high time we face the hard facts and deal with the real issues….if FKF is going to pay lower tier clubs 1 million bob per month and top tier clubs are being paid 0.75 million bob per month what is the next logical action………….mass exodus of players from top tier clubs to lower tier club. a quality player would rather earn less than stay at home doing nothing …which is what will happen to QUALITY KPL players !!!!

    that’s food for thought and that how Nyamweya is working, can we beat him to that game ???? !!!

    • @jakoyo why dnt you reason upright kogalo,afc,tusker, and every team playing in kpl their yearly wage is not less than 25m. nyambwehas sponsor is giving teams 9m a year n no publicity while kpl ss gives 7.5m and gvs publicity n exposure.if a studnt skip from class 1 to 8 he will nt hv tym to learn all basic.we cant go back n play low tier teams we r in a league wea thea is real footbal ie gor vs mathare game.why do u enjoy to be no one in a fools school?lets wait n c if anyone will watch ligi ndogo vs nzoia united or tusker vs afc.some teams will neva hv even 50 fans n without sponsors or fans how wil the teams manage 1m?salaries,transport,allowances?ni ngumu.kogallo can hv 2 home matches which can give them 3m in gate collection per month.

    Jakoyo, you must be working on some “chicken” influence. How do you keep on talking like that? These main teams cannot just be destroyed at some individual’s whim like that, it is people like you who are betraying the cause of the true soccer lover in this country. We are all against these moves, how comes you are supporting them?

      My brother JTG, this is an avalanche and who is Jakoyo to stand in its way when we are all scampering away towards Nyamweya with our tails between our legs? I must laud the solid, steadfast, principled and unwavering stand consistently taken by Dan Original on this saga. This matter is big. Personally I am only barking in the backyard with my tail between my legs. This matter is big indeed. I was shocked to learn that seasoned fans like our blog’s chief combat strategist and commander of the brave and defiance unit whom we all know, has thrown in the towel and is urging K’Ogalo to align with FKF; a move which will effectively make us accomplices in Nyamweya’s mission of destruction of soccer and propagation of poverty in Kenya and the 3rd world at large.

      bloggers lets be sensible on this matter of life and death ……….Nyamweya intention is too see KPL players suffers and in essence cripple the league as there will be mass defection of players from KPL to FKF. without these players clubs will collapse.. he would rather have low tier club players earn more money than top tier club players. are we that blind ????????? .

      So if you are a Kogallo player where would you rather be ? stay at home and do nothing or join the lower tier teams and play some football , no matter how good you are ….its better than NOTHING .

      the issue is not about me, you , Kogallo, FKF, KPL , jakom or the CS, its about the players who are bound to suffer and languish at home doing nothing bearing in mind that transfer season for most countries are closed. Maybe Ulinzi FC can talk like most bloggers because besides football they have other jobs, the same can be said of Bandari and perhaps a few other clubs in the KPL team.

      So before throwing stones at other, where would you rather be as a player who does not have another job and cannot join another club in another country ?…..

    I hope that all the KPL teams have registered as per the New Sports Act. This might be the basis of the CS making his decision on the KPL FKF saga
