Gor Mahia face Potential FIFA sanctions over Oboya

Kenyan Premier League (KPL) champions Gor Mahia and midfielder Patrick Oboya are staring at possible sanctions from world body Fifa over an alleged irregular signing of the player. Two weeks ago, Fifa queried over how the player was acquired by Gor Mahia and demanded an explanation from the club. This could also be the reason, Gor Mahia have not been using the player of late in their Kenyan Premier League (KPL) matches as they wait to sort out the matter with Fifa. Prior to joining Gor Mahia, Oboya was contracted to Vietnamese Super League side Thanh Hoa where he stayed for hardly three weeks before both parties terminated the contract. He was previously at Slovakian club MFK Ruzomberok before moving to Vietnam and eventually to Gor Mahia.

The club through Assistant Secretary General Ronald Ngala said they do not know who has complained to Fifa about the signing of Oboya which he insists only went ahead after they were given the go ahead by Football Kenya Federation (FKF). “When we expressed interest in the player, we asked for his ITC through FKF who after some time felt it was alright to use the player and they duly registered him.”

“We are equally surprised by the query from Fifa and we do not understand where it is coming from. We have wrote back Them explaining that he is indeed our player and how we acquired him. “At the moment we cannot say what will happen. We just have to wait and hear what Fifa has to say to our reply,” said Ngala. Ngala was evasive on whether this is the reason the player has not been featuring in KPL matches insisting that the decision to field him is solely upto the coach.
“It is not entirely why he has been out of the squad. It could be a reason but then again, the decision to use a player is upto the coach,” Ngala explained. Football Kenya Federation (FKF) Transfer Matching System manager Nick Mwendwa, confirmed the query by Fifa but absolved the federation from blame. “Clubs normally make direct request for an International Transfer Certificate (ITC) with a log in provided by the federation. In the case of Oboya, Gor Mahia never did that,” he explained. Accepted responsibility Mwendwa, however, accepted responsibility for not following up to ensure that the club made the request but instead gave the go ahead for Gor Mahia to field the player based on a terminated contract he provided to the federation. “I gave the go-ahead for Gor Mahia to use the player when he presented a document showing that he had terminated his contract with the Vietnamese club on mutual consent.

“When such matters arise, Fifa insists that whatever action is taken favors the player and this is what I had in mind in giving him consent to play.

“However, even then Gor Mahia should still have followed up on the ITC,” he said. A source close to the player however blamed FKF, Kenyan Premier League (KPL) and Gor Mahia for allowing the player on the pitch without this vital document. “Did Gor Mahia request for the ITC? Why did KPL and FKF allow him to take to the pitch without it,?” he wondered. It is not clear what kind of sanctions could be slapped on the club if they are found guilty but this could range from losing points, a hefty fine or suspended from signing players for a particular period of time.
The player could also be suspended if it is proved that he misled Gor Mahia about his status prior to signing for them.

    Does this mean that Gor will forfeit all points they got in matches that Oboya featured? Ingwe might after all end up being the 2013 KPL champions

    The EC is a let down to Gor fraternity not issue to do with tax, Stadium payment and now ITC issue . AR poor management skills and unproffessionalism in running the club has been exposed to the core. I dont think the current EC can take us to another level that most of the fans envision given poor strategies they have and their failure to embrace bright ideas that have been suggested here by brother Mwakio and other bloggers.
    All we need is a full time secretariat who are proffesionals in their specific positions.Mr AR wake UP!!!!!before our beloved club come crumbling down.

    How I wish AR would be giving us the state of the club on a monthly basis but that will be like playing guitar to a goat. Unfortunately our love for Gor makes them( and him) get away with anything but they should know that the pent up emotions will one day require a safety valve.

    @PROFESSIONALIZATION: what do u think of turning our club into a limited company where our fans via branches buy shares which are then invested in blue chip companies to make returns for the club and fans in form of dividends.Rachier is a world class lawyer let him revolutionise our clubs operations.We want to be a topnotch club in AFRICA, where we were before

  • this club will die if not urgent measure is taken to salvage it there is too much ineptitude in its management ranks to an extent of being a national shame to the supporters could someone join me and call for a gormahia national dialogue , some bloggers go to an extent of calling others stupid when they question the competence of the office its a shame whenever i sit out in the Indian ocean to enjoy, sometimes i used to don gor replica but not any more i blog less for there are better bloggers who are out o protect this big mess ….. we have patron dont we change the current concept of the club as it now is not working we better visit the katiba ya club with an urgent need to change it if not the silly way its run horrendous completely i did some donation via a friend could i get the bank account and swift code for the club i would do some more rupees send it to me via babaongow@yahoo.com

  • Bloggers i think it is the january deal which is bringing all these problems.The loan of last year,both the clubs reached the agreement for the guy to be on loan at gor mahia,let us wait for fifa to give us there verdict but what i know the kenyan football federation will be asked to answer some tough questions first before they reach the club.

    I just wonder when the Mighty K’galo will ever b about football.
    Granted Oboya has had his moments but from the begining this was an EC engineered transfer. The guy came with an injury, has been sparingly used not 2 mention being alledgely part of the group causing disorder at the club.
    A chain is only as strong as its weakest link & GM’s weakest link is the EC. Its something that saddens yet a known group bloggers turn abusive when this is pointed out.These issues nid a SGM first not…

  • Mpesa paybill for collecting monies.
    I repeat with this EC putting money in that Mpesa account is akin 2 using a straw basket 2 fetch water 2 put out the fire engulfing our beloved club.
    Remember most of this issues are inherited from the prevoius EC reelected officials I.e starting with AR, Killo, Ngala, Okuku should be held accountable for these messes.
    Sooner or later the effects of these errors (given their huge magnitude) of commission/ommission will affect the performance on the pitch.

  • The Executive Committee and Ambrose Rachier are failing the Gor Mahia family. Do we have a recalling clause in Gor Mahia constitution and what are the procedures? Because at this rate their mandate is unattainable.
